These Terms and Conditions govern the access and use of the SafetyVideos.com Learning Management System (the “LMS”) hosted at lms.safetyvideos.com. This LMS is owned and operated by Clever Solutions, Inc. d/b/a SafetyVideos.com (“we,” “us,” or “our”).

1. Acceptance of Terms

By accessing the LMS, creating an account, or assigning training to users, you and the organization you represent (the “Customer”) agree to these Terms. If you are an individual user, you also agree to comply with these Terms as a condition of your training access.

2. User Accounts and Security

  • Account Responsibility: Users are responsible for maintaining the confidentiality of their login credentials. Any activity occurring under a user account is the responsibility of the account holder and the sponsoring organization.

  • No Credential Sharing: Licenses are granted on a per-user basis. Sharing login credentials between multiple individuals or across different organizations is a violation of this license and may result in immediate suspension of access without refund.

3. Digital Training License

Upon purchase of training credits or course access, Clever Solutions, Inc. grants the Customer a limited, non-exclusive, non-transferable license to deliver the specified training to authorized employees or students.

  • Prohibited Use: You may not record, screen-capture, download, or redistribute the video content within the LMS.

  • Term of Access: Course access is provided for the duration specified at the time of purchase. Expired credits or access periods are not subject to refund unless otherwise stated in writing.

4. Educational Records and FERPA

For educational institutions, Clever Solutions, Inc. acts as a “School Official” under the Family Educational Rights and Privacy Act (FERPA).

  • Data Purpose: We collect student names and progress data solely to facilitate the training and certification process requested by the institution.

  • Confidentiality: We maintain the confidentiality of these records and will not share them with third parties except as authorized by the institution or required by law.

5. Organizational Administrator Authority

If your account is managed by an employer or school administrator, that administrator has the authority to view your progress, test scores, and completion certificates. Clever Solutions, Inc. provides this data to the Customer to assist with compliance tracking and is not responsible for how the Customer utilizes this information.

6. Safety and Liability Disclaimer

The training provided via the LMS is for educational purposes.

  • Inherent Risks: While we strive for accuracy, safety regulations are subject to change and local variation.

  • Limitation of Liability: Clever Solutions, Inc. shall not be liable for any workplace injuries, regulatory fines, or damages resulting from the application of the information contained in the LMS. Completion of a course does not, by itself, constitute professional certification for high-risk equipment without hands-on, site-specific evaluation by the employer.

7. Data Protection & System Integrity

We use administrative and technical safeguards, including SSL/TLS encryption and secure data storage, to protect the integrity of the LMS and your training records. You agree not to attempt to bypass any security features, use automated “scrapers” to extract video data, or interfere with the performance of the LMS.

8. Governing Law and Venue

These Terms are governed by the laws of the State of California. Any legal action arising from the use of the LMS shall be filed exclusively in the courts of San Diego County, California.
